Use it. Don't resell it.
Pixel Drop is licensed under Apple's Licensed Application End User License Agreement — the Standard EULA — for every copy obtained from the Mac App Store. The summary below explains what that means in plain language; the Apple agreement is the binding text.
1. The licence you get
Pixel Drop is licensed, not sold. You receive a personal, non-transferable licence to use the app on any Apple-branded device that you own or control, as permitted by the App Store Terms of Service and Apple's Standard EULA — including use by other members of your Family Sharing group.
2. Ownership
Pixel Drop, its source code, name, icon, and design remain the property of Nicholas Grey and are protected by copyright and other intellectual property law. Nothing in these terms transfers ownership. Colors you sample with the app are entirely yours — we claim no rights over anything you create with it.
3. What you may not do
- Copy, redistribute, resell, rent, or sublicense the app.
- Reverse engineer, decompile, or disassemble it, except where that right cannot be excluded by law.
- Remove or alter any copyright or attribution notice.
- Use the app to break the law, or to circumvent the security or privacy protections of any system.
4. No warranty
Pixel Drop is provided "as is" and "as available", without warranty of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that sampled values will be suitable for any specific colour-critical workflow. Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you.
5. Limitation of liability
To the maximum extent permitted by law, Nicholas Grey is not liable for indirect, incidental, special, or consequential damages, or for lost profits or lost work, arising from your use of or inability to use Pixel Drop. Nothing here limits liability that cannot be limited by law, including liability for death, personal injury, fraud, or gross negligence.
6. Support and maintenance
Nicholas Grey — not Apple — is solely responsible for support and maintenance of Pixel Drop. Reach support at milano@greyinds.com. Apple has no obligation to furnish any support services for the app.
7. Privacy
Use of Pixel Drop is also governed by our Privacy Policy, which is available in the app and on this site. In short: the app collects nothing.
8. Termination
This licence lasts until terminated. It ends automatically if you breach these terms, and you may end it at any time by deleting the app. On termination you must stop using Pixel Drop and remove all copies. Sections 2, 4, 5 and 9 survive termination.
9. Third-party beneficiary and governing terms
Apple and its subsidiaries are third-party beneficiaries of this agreement and may enforce it against you. You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
These terms are governed by the laws of Italy, without regard to conflict-of-law rules, and without depriving you of any mandatory consumer protection in your country of residence. Where these terms and Apple's Standard EULA conflict, the Apple agreement prevails.
